Article 1 (General Provisions)
- 1.
- The purpose of these Terms and Conditions is to stipulate the basic matters when KDDI Corporation and Okinawa Cellular Telephone Company (hereinafter referred to as "we, etc.") provide the Program (defined in Article 2).
- 2.
- The Program is provided based on these Terms and Conditions as well as other conditions separately stipulated by the Company, etc. (hereinafter referred to as the "Individual Conditions," and these Terms and Conditions and the Individual Conditions are collectively referred to as the "Terms, etc."). If the contents of these Terms and Conditions differ from the contents of the Individual Conditions, the contents of the Individual Conditions shall take precedence.
Article 2 (Definition of Terms)
In these Terms and Conditions, each term shall have the following meaning. Terms not defined in this Article shall be defined in accordance with the definitions set forth in the povo2.0 Communication Service Agreement separately established by the Company, etc. If other terms and conditions, regulations, etc. referenced in these Terms and Conditions are updated, the latest content shall apply.
- (1)
- "Introducer" means a povo2.0 subscriber who introduces povo2.0 communication service to a third party in a manner specified by the Company, etc.
- (2)
- "Referrer" means a person who has been introduced to povo2.0 communication service by an introducer.
- (3)
- "This Program" refers to a program that grants the Benefits to the Introducer and the Referred Person when the Referred Person fulfills the conditions set forth by the Company, such as entering the Introducer's referral code in the manner specified by the Company, completing the procedures specified by the Company, and entering into a povo2.0 agreement with the Company.
- (4)
- "Rewards" means the rewards provided to Referrs and Referees under the Program.
- (5)
- "Referrer Benefits" means the Benefits provided to the Referrer under the Program.
- (6)
- "Referred Person Benefits" means the Benefits provided to Referees under the Program.
- (7)
- "Program Site" refers to the website for this Program provided separately by the Company, etc.
- (8)
- "Referral Code" means a unique code issued by us to each povo2.0 subscriber for this Program.
- (9)
- "Fraudulent acts" refers to acts that the Company, etc., reasonably determines to be fraudulent, such as unauthorized access to this Program Site, the act of signing up for a large number of povo2.0 communication services under the same name, the act of illegally obtaining or acquiring a large number of email addresses, and the act of signing up for povo2.0 communication services by falsifying a name, email address, or other information.
Article 3 (Changes to the Terms and Conditions)
The Company, etc. may revise, add to, or change these Terms in accordance with the provisions of the Civil Code. In such cases, the terms and conditions for providing the Program shall be in accordance with the revised Terms.
Article 4 (Prohibited matters, etc.)

- povo2.0 subscribers (including introducers; the same applies below) and introduced persons shall not engage in any acts that the Company deems to be or may be deemed to be any of the following:

- Actions that violate these Terms and Conditions
- (2)
- Actions such as requesting the disclosure of personal information of third parties, or actions such as collecting information on other povo2.0 subscribers and introduced persons
- (3)
- Introducing the povo2.0 communication service to the introduced person in an inappropriate manner, such as by giving or receiving money.
- (4)
- Using the Program for commercial purposes, such as advertising products or services that you provide
- (5)
- Any act that places an excessive load on the network or system of this program or povo2.0
- (6)
- Reverse engineering or other analytical acts against software or other systems provided by the Company, etc.
- (7)
- Unauthorized access to our network
- (8)
- Using a third party's referral code
- (9)
- Allowing a third party to use your referral code
- (10)
- Actions that interfere with the operations of our company, such as the operation of the povo2.0 communication service and this program.
- (11)
- Any act that the Company, etc. reasonably determines to be inconsistent with the purpose of the Program
- (12)
- Acts that violate laws and regulations, these Terms, etc., or public order and morals (violence, cruelty, suicide, abuse, obscenity, etc.), acts that damage the reputation of the Company, etc., povo2.0 contractors, introduced persons, or third parties, acts that infringe on the property or rights of the Company, etc., povo2.0 contractors, introduced persons, or third parties, or acts that cause harm to the Company, etc., povo2.0 contractors, introduced persons, or third parties, or acts that send or display such acts.

- The act of an introducer threatening the introduced person or conveying false information when introducing the povo2.0 communication service
- (14)
- Receiving or attempting to receive referrer benefits by making repeated referrals to the same person, or by making repeated referrals to the same person
- (15)
- Repeatedly signing up for and canceling the povo2.0 communication service with the aim of repeatedly receiving this benefit
- (16)
- Impersonating a third party
- (17)
- Receiving or attempting to receive the Benefits in a manner that is reasonably deemed inappropriate by the Company, etc. or fraudulently.
- (18)
- Transferring or reselling this benefit to a third party
- (19)
- Committing or attempting to commit fraudulent acts
- (20)
- Any other conduct that the Company, etc. deems inappropriate based on reasonable grounds, in addition to the conduct set forth in the preceding items.
- 2.
- As long as it is the same person, regardless of the number of povo2.0 contracts, each person can only receive the referral benefits once as a referee.
- 3.
- The Company, etc. may set a limit on the number of times that an Introducer can receive Introducer Benefits. In such cases, the Introducer will not be able to receive Benefits in excess of such limit.
Article 5 (Non-applicability of this benefit)
- 1.
- povo2.0 subscribers (including introducers; the same applies below) and introduced persons shall not engage in any acts that the Company deems to be or may be deemed to be any of the following:
- (1)
- If the procedures required by the Company to receive the Referrer Benefits are not carried out
- (2)
- If the introducer is unable to receive the introducer benefits due to reasons beyond the control of the Company, etc.
- (3)
- If the introducer violates these terms and conditions
- (4)
- If the introducer has suspended their account
- 2.
- Even if an Referred Person meets the conditions set forth by the Company, etc., they may not be able to receive the Referred Person Benefits if any of the following conditions apply. Furthermore, even if an Referred Person is unable to receive the Referred Person Benefits, the Company, etc. will not provide the Referred Person Benefits again, and the Company, etc. shall not be liable to the Referred Person in this regard unless there is a reason attributable to the Company, etc.

- If the Referee does not enter the Referral Code in the correct manner
- (2)
- If the procedures prescribed by the Company, etc., necessary to receive the Referred Person Benefits are not carried out
- (3)
- If the povo2.0 contract of the introducer or the referee is terminated for any other reason before the referee benefits are received
- (4)
- If the Referred Person is unable to receive the Referred Person Benefits due to reasons such as the email address registered in the manner prescribed by the Company, etc. when signing the povo2.0 contract being incorrect, or emails from the Company, etc. not being received due to a spam filter, etc.
- (5)
- If the Referred Person violates these Terms and Conditions, etc.
Article 6 (Cancellation of this benefit, etc.)
- 1.
- If the Referrer or Referee falls under any of the following items, the Reward provided may be cancelled or the Reward may not be provided.
- (1)
- If you have previously applied for the povo2.0 communication service under this program and received this benefit more than the number of times specified by our company, etc.
- (2)
- If you receive this benefit in excess of the limit set by our company, etc.
- (3)
- If you violate these Terms and Conditions
- 2.
- If this benefit has been cancelled in accordance with the provisions of the preceding paragraph but you have already used it, you will be required to pay fees equivalent to the amount used.
Article 7 (Disputes, etc.)
Any transactions, communications, disputes, etc. that arise between povo2.0 subscribers, introduced parties, and third parties in connection with this program shall be resolved between the parties involved, and the Company, etc. shall not be involved in such disputes in any way.
However, this does not apply if the Company, etc. deems it reasonably necessary.
Article 8 (Termination of the Program)
- 1.
- The Company may change or terminate all or part of this Program without notice.
- 2.
- Our company may, without prior notice, suspend or interrupt the provision of the Program due to force majeure such as maintenance work, system recovery, power outages or natural disasters, or other unavoidable reasons.
- 3.
- Even if you meet the conditions of this program after the program has ended, you will not be able to receive this benefit.
Article 9 (Prohibition of Transfer of Rights and Obligations)
povo2.0 Neither the Subscriber nor the Addressee may transfer or assign any rights or obligations pertaining to the Program to any third party, or offer as security for themselves or any third party. The same shall apply in the event of termination of the povo2.0 Agreement.
Article 10 (Liability for damages)
In the event that the Company, etc. is liable for damages under laws and regulations, the Company, etc. shall be liable up to an amount of 990 yen. However, this amount shall not apply in the event of willful misconduct or gross negligence on the part of the Company, etc.
Article 11 (Governing Law)
The governing law of these Terms and Conditions shall be the laws of Japan.
Article 12 (agreed jurisdiction)
Any disputes arising out of or relating to these Terms and Conditions shall be submitted to the Tokyo District Court as the court of first instance with exclusive jurisdiction.
Article 13 (Questions regarding the Program, etc.)
If any doubts arise regarding the interpretation of these Terms and Conditions or the operation of the Program, or if any matter not provided for in these Terms and Conditions arises, the Company, the Introducer, and the Introduced Person shall negotiate in good faith.
